These terms and conditions apply to the online courses/learning journey and information provided by Pēpi Penapena Tapui Limited (“Pēpi Penapena”).
Services
Pēpi Penapena offers courses on Tūpuna Parenting and related topics. We reserve the right to adjust the course content and details to better suit the needs of our tauira (students) based on their industry or specific work. Courses may be withdrawn at any time, with thirty days’ notice.
Fees / Registration
The fee for the Course (the “Fee”) must be paid in full by the Friday before the opening wānanga for the Course. The tauira are responsible for non-payment, even if the Fee is being paid by a third party. If the Fee is not paid, the tauira will be notified that they will no longer have access to the course. Access will be reinstated upon payment of the Fee.
Courses will be billed in New Zealand Dollars (NZD). Accepted payment methods are bank transfer, or credit/debit card via Stripe. Instalment options may be negotiated on a case-by-case basis. Please note that additional fees may apply for certain payment methods.
The tauira agree to provide accurate and complete registration information. Submission of the registration form, alongside full payment of the Fee, constitutes the tauira acceptance of these Terms and Conditions. Note that certain parts of the Fee, such as administrative fees, may be non-refundable.
Cancellations
Cancellation is permitted until the end of Week 2. After this point, a refund cannot be offered, but the learning journey can be deferred. Deferrals are valid for 12 months from the date on which the tauira deferred.
Pēpi Penapena reserves the right to cancel or delay the Course by giving the tauira notice in writing (including by email) at any time before the Course start date. Pēpi Penapena will refund all fees paid by the tauira for the cancelled Course. Pēpi Penapena’s liability when it cancels a Course will be limited to a refund of the Fee or any other charges paid for the cancelled Course. For partial cancellation of a course, such refunds will be made on a proportionate basis.
Refunds will not be issued for rescheduled classes.
Copyright
All materials – including but not limited to text, photographs, video, audio, images, and any other content – appearing via the Learning Journey and/or on the Website are protected by copyrights and/or other proprietary rights belonging to Pēpi Penapena and/or other third parties. Tauira agree to abide by all applicable laws regarding copyrights, trademarks, publicity rights, and privacy rights in NZ, the US, UK, and any other jurisdiction from which you are accessing the Website.
Having completed your Learning Journey, the tauira have permission to use the resources shared, but not the Learning Journey Course content itself, for their work at the organisation listed in their registration form. Tauira may share the resources with their colleagues and clients to teach and spread the kaupapa.
Tauira may not copy, reproduce, duplicate, distribute, disseminate, publish, post, display, perform, modify, create derivative works from, upload to, transmit, or in any way exploit any content from the Learning Journey and/or on the Website without express permission from Pēpi Penapena. Tauira may not sell or offer for sale any of the content, or allow third parties to access it, or use such content to construct any kind of database.
The materials may only be used by individuals who have received training from Pēpi Penapena.
Tauira will not share these resources with others outside of their current organisation to use in their work, nor will they use or share these resources in work they may do outside of the organisation listed in the registration form. If the tauira stop working at the organisation in their registration form, there is the option to purchase an individual copy of the materials and sign an agreement directly with Pēpi Penapena to continue to use these resources.
Tauira agree to maintain the security of any username and password required for accessing the Learning Journey. Tauira will notify us promptly if they become aware of any unauthorised use of their username and/or password. Only the tauira may access the course using their login details.
Data Protection
By registering for the Learning Journey, tauira consent to Pēpi Penapena collecting and using personal data in compliance with our privacy policy and the New Zealand Privacy Act 2020.
Technology Requirements
The tauira must ensure they have the necessary hardware, software, and Wi-Fi access for online participation. Pēpi Penapena is not liable for access errors or failures.
Limitation of Liability
Except in cases of intentional misconduct or gross negligence, Pēpi Penapena assumes no liability for any damages caused in connection with the services under this agreement. This includes but is not limited to damages in the form of data loss, failure to operate, lost revenue, or missed profits.
Force Majeure
Pēpi Penapena will not be liable for any failure or delay in performing its obligations under these terms due to any cause beyond its reasonable control, including but not limited to acts of God, war, strikes, pandemics, or government regulations.
Term
The service is provided for the duration of the course.
Modification of Terms
Pēpi Penapena reserves the right to modify these terms and conditions at any time. The tauira will be notified of any changes via email, and their continued use of the Course after such modifications will constitute their acceptance of the new terms.
Law and Venue
Disputes are subject to New Zealand law and must be brought before New Zealand courts.
