Terms and Conditions


These terms and conditions apply to online courses and information provided by Pēpi Penapena Tapui Limited (“Pēpi Penapena”).
Services

Pēpi Penapena offers courses relating to Tūpuna Parenting and related topics. Pēpi Penapena reserves the right to amend the Course and alter details at its discretion. The main reason to do this will be to make content more relevant to tauira (students) depending on their industry or specific work they are involved in. Courses may be withdrawn at any time, subject to thirty days prior notice.

Payment / Registration

The fee for the Course (the “Fee”) must be paid in full by the Friday before the opening wānanga for the Course. You are responsible for non-payment, even if the Fee is being paid by a third party. If your Fee is not paid, you will be notified that you will no longer have access to the course. Access will be reinstated upon payment of the Fee.

Courses will be billed in New Zealand Dollars (NZD). Accepted payment methods will be bank transfer.

You agree to provide accurate and complete registration information. Submission of your registration, alongside full payment of the Fee constitute your acceptance of these Terms and Conditions.

Cancellations and Refunds

You may cancel your registration up to the end of Week 1 of the Course (the week of the opening wānanga). After this point, a refund cannot be offered, but the learning journey can be deferred.

Pēpi Penapena reserves the right to cancel or delay the Course by giving you notice in writing (including by email) at any time before the Course start date. Pēpi Penapena will refund all fees paid by you for the cancelled Course. Pēpi Penapena’s liability when it cancels a Course will be limited to a refund of the Fee or any other charges paid for the cancelled Course. For partial cancellation of a course, such refunds will be made on a proportionate basis. All dates are subject to change, however notice of such change will be given and refunds will not be issued for any rescheduled class.

Copyright

All materials – including but not limited to text, photographs, video, audio, images and any other content – appearing via the Course and/or on the Website are protected by copyrights and/or other proprietary rights belonging to Pēpi Penapena and/or other third parties. You agree to abide by all applicable laws regarding copyrights, trademarks, publicity rights and privacy rights in NZ, the US, UK and any other jurisdiction from which you are accessing the Website.

Having completed your Course, you have permission to use the resources shared with you, but not the Course Content itself, for your work you do at the organisation you listed in your registration form. You may share the resources with your colleagues and your clients to teach and spread the kaupapa.

You may not copy, reproduce, duplicate, distribute, disseminate, publish, post, display, perform, modify, create derivative works from, upload to, transmit, or in any way exploit any content from the Course and/or on the Website. You may not sell or offer for sale any of the content, or allow third parties to access it, or use such content to construct any kind of database.

At no time can the held materials be used by anyone who has not been trained to use the materials by Pēpi Penapena. You cannot train any colleagues to use the resources unless you have undertaken a train-the-trainer programme and have the agreement to train others from Pēpi Penapena.

You will not share these resources with others outside of your current organisation to use in their work, nor will you use or share these resources in work you may do outside of the organisation you listed in your registration form. If you stop working at the organisation in your registration form, you will have the option to purchase an individual copy of the materials and can then sign an agreement directly with Pēpi Penapena to continue to use these resources.

You agree to maintain the security of any user name and password required for accessing the Course. You will notify us promptly if you become aware of any unauthorized use of your username and/or password. Only you may access the course using your login details.

Data protection

By registering with Pēpi Penapena and by paying the fees, you agree to Pēpi Penapena collecting and using your personal data. This will be done in accordance with Pēpi Penapena’s privacy policy, and complying with the New Zealand Privacy Act 2020.

Technology requirements

The Course is facilitated through an online learning management system. It is your responsibility to ensure that you have the proper hardware and software requirements, along with access to Wi-Fi, to be able to participate in the Course. Pēpi Penapena is not be responsible for any errors or failures in relation to your ability to access the Course, the Website or any related materials, including where such errors or failures are caused by: (i) a loss of connection on Pēpi Penapena’s or your end; (ii) a breakdown or problems with the online software and/or (iii) a breakdown or problems with your internet connection, computer or system.

Limitation of liability

Except in case of intentional misconduct or gross negligence, Pēpi Penapena accepts no liability for any damages caused in connection with the services under this agreement. This includes but is not limited to damages in the form of data loss, failure to operate, lost revenue or missed profits.

Term

The service is provided for the lifetime of the course, as decided by Pēpi Penapena.

Law and venue

Any disputes in connection with this agreement are governed by New Zealand law and must be brought before the courts of New Zealand.
